FCC Facilitates Shared Use of Lower 37 GHz Band, Examines Upper Microwave Emissions

The FCC has taken action to increase spectrum efficiency by adopting a Report and Order that establishes a framework for co-primary sharing of the 37-37.6 GHz band (Lower 37 GHz) between federal and non-federal entities. This move will enable a diverse range of applications, including backhaul and backbone links, fixed wireless broadband systems, IoT deployments, and supplemental mobile capacity, all through site-specific authorizations. The FCC worked with the NTIA and considered input from the DoD and other stakeholders to create an initial coordination mechanism for this shared spectrum access.


This decision reflects the FCC's ongoing commitment to maximizing the availability of millimeter wave spectrum, which is seen as crucial for driving economic growth and fostering innovation in the U.S. wireless landscape. The 600 MHz of spectrum made available through this order presents significant opportunities for both commercial and government services.


In a related action, the FCC has also issued a Further Notice of Proposed Rulemaking (FNPRM) to explore potential revisions to the emissions limits for Upper Microwave Flexible Use Service (UMFUS) operations above 37 GHz. This consideration is aimed at protecting passive sensors operating in the adjacent 36-37 GHz band. Additionally, the FNPRM seeks feedback on potential enhancements to the coordination process for the Lower 37 GHz band, including examining factors like clutter, the possibility of an automated portal, and the potential for future dynamic sharing approaches.
