New FCC Requirements for Modular Transmitters and Covered Equipment

The Federal Communications Commission (FCC) has released a Second Report and Order (FCC 25-71) in ET Docket No. 21-232, clarifying and expanding the rules regarding the authorization of equipment from entities identified on the "Covered List." These updates specifically address the integration of modular transmitters into host devices.
Key Regulatory Changes
Modular Transmitter Classification: The FCC has clarified that the prohibition on "covered equipment" (equipment from entities deemed national security risks) explicitly includes modular transmitters.
Authorization of Host Devices: The Order adopts a prohibition on the authorization of any device that incorporates a modular transmitter identified as covered equipment. This applies even if the host device itself is not produced by a covered entity.
Limitation of Past Authorizations: New procedures have been established to limit previously granted authorizations for covered equipment, with the goal of preventing the continued importation and marketing of such items.
Compliance and Implementation
Attestation Requirements: Under the new rules, applicants for equipment authorization and responsible parties must formally attest that the equipment in question, including any integrated component parts like modular transmitters, does not consist of covered equipment.
Laboratory Oversight: Laboratories must ensure that testing and certification support for FCC approval procedures align with these updated national security objectives.
